By accessing or using the services provided by APEX FITNESS Inc. ("APEX FITNESS"), including our facilities, website, mobile application, and any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use our Services.
Eligibility: You must be at least 18 years old to purchase a membership. Individuals aged 14–17 may use APEX FITNESS facilities with a signed parental/guardian consent form and must be accompanied by an adult member during all visits.
Membership Plans: APEX FITNESS offers various membership tiers (Basic, Pro, Elite) with different levels of access and benefits. Full details are available on our Pricing page. All memberships are month-to-month with no long-term contracts required.
Payment: Membership fees are charged on a recurring monthly basis to the payment method on file. You are responsible for keeping your payment information current. Failed payments may result in temporary suspension of access.
You may cancel your membership at any time by providing 30 days written notice via email to [email protected] or by visiting your home location's front desk. Upon cancellation, your membership will remain active through the end of your current billing cycle. No refunds are issued for partial months. Annual prepaid memberships may receive a prorated refund minus a $50 administrative fee.
All members and guests agree to abide by the following rules when using APEX FITNESS facilities:
Physical exercise involves inherent risks including but not limited to injury, illness, or in rare cases, death. By using APEX FITNESS facilities and services, you acknowledge these risks and voluntarily assume full responsibility for any injuries or damages that may occur during your use of our facilities.
APEX FITNESS, its officers, employees, and agents shall not be liable for any personal injury, property damage, or loss resulting from the use of our facilities, equipment, or services, except in cases of gross negligence or willful misconduct.
APEX FITNESS is not responsible for lost, stolen, or damaged personal property. We strongly recommend using the provided lockers during your visit. Valuables should not be left unattended. Items left in day-use lockers will be removed at the end of each business day. Lost and found items are held for 30 days before disposal.
Guest access is available depending on your membership tier. All guests must sign a liability waiver, present valid photo ID, and be accompanied by the sponsoring member at all times. Each individual may visit as a guest a maximum of 3 times per calendar year; after that, a membership purchase is required.
All content, branding, logos, website design, mobile application, training programs, and materials created by APEX FITNESS are the exclusive property of APEX FITNESS Inc. and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.
APEX FITNESS reserves the right to modify these Terms of Service at any time. Material changes will be communicated via email and/or posted prominently on our website at least 30 days before taking effect. Continued use of our Services after changes take effect constitutes acceptance of the updated Terms.
